These Terms & Conditions apply to all participants undertaking any trek, yatra, or tour operated by WeXplorers – The Free Souls, a venture of Himalayan Tourism Services LLP. By booking or participating, you confirm acceptance of all terms stated herein.
If the participant cancels their booking, the following refund applies:

Refunds will be processed within 7–10 working days of written cancellation. Transaction charges, permit fees, and processing charges (if already incurred) are non-refundable.

Due to high-altitude terrain and border regulations:
No refund shall be applicable for unavoidable itinerary changes.
If the journey is extended beyond the scheduled itinerary due to circumstances beyond the control of the organizers, including but not limited to:
All additional expenses incurred during the extended stay, including accommodation, meals, transportation, fuel, driver allowances, and permit extensions (if applicable), shall be borne entirely by the participant(s).
The company shall not be held liable for financial losses arising from such extensions.

The company shall not be liable for:

The participant acknowledges that this high-altitude Himalayan yatra involves inherent risks.
In the event of any injury, permanent disability, medical complication, or death occurring during the journey, whether due to natural causes, terrain conditions, unforeseen events, or circumstances beyond reasonable control, the participant and/or their legal heirs agree that:
WeXplorers – The Free Souls, Himalayan Tourism Services LLP, its partners, employees, guides, drivers, representatives, and affiliates shall not be held liable in any manner whatsoever.
This waiver shall be binding upon the participant and their legal heirs.
The participant agrees to indemnify, defend, and hold harmless WeXplorers – The Free Souls and Himalayan Tourism Services LLP, its partners, employees, guides, drivers, representatives, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:
This indemnity shall survive completion of the journey.
The company shall not be liable for delay, alteration, extension, cancellation, loss, or damage caused by events beyond its reasonable control, including but not limited to:
No compensation shall be payable under such circumstances. Any additional expenses shall be borne by the participant(s).
Travel insurance is not included in the package. Participants are strongly advised to obtain personal accident, medical, and evacuation coverage.
All disputes shall be subject to the jurisdiction of the courts of Pithoragarh, Uttarakhand.

ये नियम एवं शर्तें WeXplorers – The Free Souls (Himalayan Tourism Services LLP) द्वारा आयोजित सभी ट्रेक, यात्रा एवं टूर पर लागू होती हैं। बुकिंग या भागीदारी द्वारा आप सभी शर्तों को स्वीकार करते हैं।
यदि प्रतिभागी रद्द करता है:

रिफंड 7–10 कार्य दिवसों में प्रोसेस किया जाएगा। ट्रांजैक्शन चार्ज, परमिट फीस आदि रिफंडेबल नहीं हैं।
कंपनी निम्न कारणों से यात्रा रद्द या स्थगित कर सकती है:
ऐसी स्थिति में:
कोई अतिरिक्त मुआवजा नहीं दिया जाएगा।
इन कारणों से कोई रिफंड नहीं मिलेगा।
यदि यात्रा निम्न कारणों से बढ़ती है:
कंपनी इसके लिए जिम्मेदार नहीं होगी।
मैं समझता/समझती हूँ कि यह यात्रा:

कंपनी निम्न के लिए जिम्मेदार नहीं होगी:
यात्रा पूरी तरह प्रतिभागी के अपने जोखिम पर है।
यात्रा के दौरान किसी भी प्रकार की चोट, बीमारी, स्थायी विकलांगता या मृत्यु होने पर:
WeXplorers – The Free Souls एवं Himalayan Tourism Services LLP किसी भी स्थिति में जिम्मेदार नहीं होंगे।
यह शर्त प्रतिभागी एवं उसके परिवार/कानूनी उत्तराधिकारियों पर लागू होगी।
प्रतिभागी सहमत है कि वह कंपनी, उसके कर्मचारियों एवं सहयोगियों को किसी भी कानूनी दावा, नुकसान या खर्च से सुरक्षित रखेगा, यदि वह दावा प्रतिभागी के कार्यों या लापरवाही के कारण उत्पन्न होता है।
प्राकृतिक आपदाओं, सरकारी आदेश, युद्ध, महामारी, मौसम या अन्य अनियंत्रित परिस्थितियों में कंपनी जिम्मेदार नहीं होगी।
ऐसी स्थिति में अतिरिक्त खर्च प्रतिभागी द्वारा वहन किया जाएगा।
यात्रा बीमा शामिल नहीं है। प्रतिभागी स्वयं बीमा करवाने के लिए जिम्मेदार है।
सभी विवाद पिथौरागढ़, उत्तराखंड की अदालत में ही निपटाए जाएंगे।
